Абсолютизм власти монарха был типичным для правовых систем до примерно 300 г. до н.э. Прежде люди верили, что их законы были даны им богами, которых представляли их цари. В греческой системе подчеркивалось, что закон создается человеком, для человека, и может быть изменен человеком. Вместо того, чтобы стать инструментом полного социального контроля монарха над всем народом, закон должен был служить миру и процветанию народа.

В 621 г. до н.э. Дра́кон, или Дра́конт, афинский законодатель, составил первый в Греции кодекс законов. Этот суровый кодекс наказывал как за тривиальные, так и тяжкие преступления в Афинах смертью. Слово «драконовские» (безжалостные) до сих пор используется для описания репрессивных правовых мер.

В 594 г. до н.э. Солон, законодатель из Афин, отменил кодекс Дракона и опубликовал новые законы, сохранив только законы Дракона об убийствах. Он пересмотрел каждый закон, за исключением законов об убийствах, и сделал афинский закон более гуманным. Он также сохранил древнегреческую традицию - суд присяжных. Порабощение должников было запрещено, как и большинство суровых наказаний кодекса Дракона. По закону Солона граждане Афин могли быть избраны в собрание, и были созданы суды, в которых граждане могли обжаловать решения правительства.

Греческие идеалы были перенесены в римскую правовую систему. Греки привнесли в нее понятие «естественного права». Собственно, естественное право основывалось на идее о том, что некоторые основные принципы выше законов нации. Эти принципы вытекают из природы людей.

По мере расширения Римской империи был составлен свод законов для решения более сложных юридических вопросов того времени. Это было сделано при поддержке византийского императора Юстиниана I (529 – 565 до н.э.). Этот свод законов и их толкований был назван Corpus Juris Civilis («Тело гражданского права»). Известен также под названием «кодекс Юстиниана».

В начале девятнадцатого века французский император Наполеон внес некоторые изменения в кодекс Юстиниана. Кодекс Наполеона до сих пор является образцом правовых норм, регулирующих большинство современных государств Европы.
