Вищі органи державної влади Канади

   Законодавча влада у країні належить Королеві (голові держави) в особі генерал-губернатора та парламенту. Кожний закон схвалює уряд від імені Королеви, але повноваження щодо втілення законів надаються йому від імені канадського народу. Парламент складається з Палати громад (нижній) та Сенату (верхній).
   Зазвичай Сенат складається із 104 членів: 24 - з Приморських провінцій (Ю-з Нової Шотландії, 10 - з Нью-Брансвіка, 4 - від острова Принца Едуарда); 24 - з Квебека, 24 - з Онтаріо, 24 - із західних провінцій (по 6 - з Манітоби, Саскачевана, Альберти та Британської Колумбії); 6 - з Ньюфаундленда та по одному з Території Юкон та Північно-Західних територій. Передбачено також наявність чотирьох або восьми спеціальних сенаторів - по одному чи по двоє з Приморських провінцій, з Квебека, з Онтаріо та із Заходу. Проте скористалися з цього лише одного разу - у 1990 р. Сенатори призначаються на посаду генерал-губернатором за рекомендацією прем'єр-міністра і залишаються на посту до 75-річного віку, за умови, що, перебуваючи на посту, жодного разу не пропустили двох послідовних сесій парламенту. До 1965 р. сенатори перебували на посаді довічно, лише кілька з них, що зайняли посади до цієї дати, зберігають сьогодні свої місця. Сенатором може стати особа, якій виповнилося ЗО років, вартість реального майна, а також розмір загального чистого банківського активу мають складати щонайменше 4400 доларів. Сенатори, як правило, мешкають у провінції або на території, де вони призначені на посаду. Що стосується Квебека, сенатори повинні мешкати або мати свій виборчий ценз в одному з 24 сенаторських округів Квебека, де вони призначені на посаду. Сенат має право пропонувати до прийняття будь-які законопроекти, за винятком тих, що стосуються витрат народних коштів та оподаткування. Він може доповнити та відхилити будь-який законопроект, причому стільки разів, скільки вважає за потрібне. Жоден законопроект не стане законом, якщо не буде схвалений Сенатом. Такі повноваження видаються на перший погляд завеликими, що робить верхню палату сильнішою, та протягом майже 40 років Сенат жодного разу не відхилив законопроекту, що його прийняла Палата громад. Але траплялися випадки, коли Сенат вимагав внесення поправок, з якими Палата громад не погоджувалася. Так, у 1989-1990 роках Сенат наполягав на внесенні поправки до законопроекту про страхування безробітних, з якою Палата громад не погоджується й дотепер. Та більшість поправок, внесених Сенатом до законопроектів, має роз'яснювальне значення. Основна робота Сенату зосереджується у комісіях, де опрацьовуються статті законопроекту з урахуванням розбіжностей думок та доказів, що надійшли від різних груп та окремих людей. Комісії працюють ефективно, адже чимало членів Сенату є компетентними спеціалістами і мають багаторічний досвід роботи в юриспруденції, бізнесі та управлінні. Тому Сенат досяг значних успіхів у вивченні багатьох злободенних суспільних проблем.
   Палата громад - основний орган, що створює законопроекти. Він складається з 301 члена, і кожен з них представляє виборчий округ. Від кожного виборчого округу обирається той кандидат, який набрав найбільшу кількість голосів, навіть якщо це складає менше половини загальної кількості (за мажоритарною системою відносної більшості). Депутати обираються шляхом загальних прямих виборів терміном на п'ять років. Кількість округів змінюється після загального перепису населення, згідно з Конституцією та Законом про регулювання меж виборчих округів, за якими кількість парламентських місць визначається з урахуванням щільності населення. Кожна провінція може мати стільки членів у Палаті громад, скільки мала у Сенаті до 1982 р. Виборчі округи часом відмінні за розмірами, але у визначених межах.
