Многие философы предложили принципы справедливости, которые являются  более теоретическими, чем повседневное понятие справедливости, и временами правительства попадают под влияние философов. Но в целом, правительства опираются на более практические соображения, такие как возрастающий уровень преступности или групп давления (лобби) .Иногда законы - просто попытка реализации общественного порядка. Для большинства людей очевидно, что опасное поведение должно быть подвергнуто наказанию;что отцы должны оказывать финансовую своим детям в случае ухода из семьи; то, что человек должен получить  компенсацию за ущерб, когда кто-то  расторгает соглашение с ним или нею. Но чтобы  осуществляться на деле , правильное поведение  должно быть прописано в законе, и когда  пишутся законы, становится ясно, что правильное поведение не такой простой вопрос. Все вместе это - сложный процесс, основанный на долгом наблюдении за многими различными людьми в различных ситуациях. Законы, которые обоснованы общественным порядком, не вполне определяют общественный порядок, пока они не прописаны в праве.На практике  правительства являются единственным  социальным институтом, заинтересованным исключительно  в создании сдерживающей власти, ясно мыслящей и осуществляющей контроль за справедливостью и общественным порядком. Они объединяют много целей и наследуют много традиций. Законы, которые они создают и реализуют  в жизнь, призваны избежать  беспорядка.
